Terms of service.
This Terms of Service policy applies between you, the User of this Website and Space + Matter, the owner and provider of this Website. This Terms of Service policy applies to your purchase of services whether through this Website or directly from Space + Matter outside of this Website.
Please read these Terms of Service carefully.
1. SERVICES
Please refer to your online booking details, the Proposal Letter or Quotation for details where applicable.
2. OUR FEES
Once designs and schedules etc. are approved by the Client, any further changes requested by the Client will incur the additional time charges as set by SPACE+MATTER DESIGN Ltd. Clients will be informed of said time charges when they enter into contract with us either by purchasing our online services or within our Proposal Letter or Quotation.
3. PLANNING PERMISSION, BUILDING REGULATIONS APPROVAL, PARTY WALL CONSENTS
Unless otherwise stated, the fees and costs associated with applying for Planning Permission, Building Control Approval and Party Wall Consents are NOT included in our quotes. They will be charged separately to the Client, at the rates set by the Local Authority or an approved external provider.
4. OTHER CHARGES
Once Construction or Installation works begin on site, any changes, post approval, requested by the Client will incur the hourly rate charges of all team members and the costs for external suppliers required to complete the requested additional tasks.
5. OTHER SERVICES
The following activities do not form part of the Services unless identified as ‘Other Services’ within our proposal or quote. They will be quoted for separately if required for progression of the project or requested by the Client:
o Models and special drawings e.g. 3D visualisations and walk-throughs
o Specialist and custom material samples
o Negotiating approvals by statuary authorities
o Making submissions to and negotiating approvals by landlords, freeholders etc.
o Preparing a schedule of dilapidations
o Services in connection with Party Wall negotiations
o Negotiating a price with a contractor (in lieu of tendering)
o Dealing with extensions of time and contractor’s claims
o Services in any dispute between the Client and another party
o Services following damage by fire and other causes
o Services following suspension, termination of any contract or agreement with or the insolvency of any
other party providing services to the project
o Services in connection with government and other grants.
6. EXPENSES and DISBURSEMENTS
Expenses and disbursements will be charged in addition to the fee(s) at net cost + taxes/duties plus a handling charge of 15% of the outlay where applicable. Clients will be informed, wherever possible, prior to the expense being undertaken.
The specified expenses are:
o Purchasing of maps and contract documentation
o Plotting, printing, copying, photography and sundries. Should these items be carried out by SPACE+MATTER DESIGN Ltd. the costs shall be commensurate with commercial prices for the same tasks.
o Statutory fees
o Travel. Where applicable, travel by car shall be charged at the rate of 45 pence per mile.
7. FF+E SUPPLY
Supply of FF+E (Furniture Fixtures + Equipment) will be charged in addition to the fee(s). You will be provided with quotations for FF+E supply. All goods are and shall remain the property of SPACE+MATTER DESIGN Ltd until full payment of all sums owed by the Client / buyer to SPACE+MATTER DESIGN Ltd. is received.
8. FF+E INSTALLATION
Installation costs for FF+E are NOT included unless otherwise stated.
9. CANCELLATION
On agreement to the Quotation and payment of subsequent invoices, should the Client no longer wish to use our services, they must inform us in writing (via email or post) within 7 calendar days from the invoice issue date. Work on the project will cease and the Client will be billed only for work that has been carried out up until and including the date the cancellation email/letter is received by SPACE+MATTER DESIGN Ltd. The Client will pay in full for any FF+E that SPACE+MATTER DESIGN Ltd has ordered/purchased on behalf of the Client, up until and including the date the cancellation email/letter has been received.
10. QUOTED PRICES
SPACE+MATTER DESIGN Ltd reserves the right to change the prices quoted at any time. Unless otherwise stated, all quotations provided by SPACE+MATTER DESIGN Ltd are valid for 30 days from the date issued.
11. DATA PRIVACY
On entering into a contract with SPACE+MATTER DESIGN Ltd, your personal details such as your name and property address will be shared with the professional services, trades and suppliers associated with delivering your project. We do not share your personal data with any other third parties. We will not share your telephone numbers or email addresses without your express permission. 12. PAYMENT TERMS: Unless already stated, TO BE ADVISED based on entering into contract with Space + Matter by purchasing services from them either through this Website or directly from Space + Matter outside of this Website.
